01 · The Short Answer

Yes, in almost every case, with two quick checks

Short stay accommodation is currently permitted throughout Brisbane, including apartments, with the usual planning and building rules applying. No council permit or registration is required today: Brisbane City Council tabled a proposed Short Stay Accommodation Local Law in December 2025 that would have introduced permits for whole-home short stays, then paused it on 12 May 2026. It never came into force.

For apartment owners, the two practical items worth a look are your building's by-laws and your insurance. Both are covered below, plainly.

02 · Your Building

Body corporate and by-laws

Every building has by-laws: its house rules for things like guest registration, key and fob access and shared facilities. Here is the part that matters. In Queensland, a body corporate cannot lawfully use by-laws to stop you letting your apartment, short stay included. By-laws shape how the building runs, not whether you can host. We read the by-laws of every building we take on as routine, and most professionally managed listings slot straight in.

Our experience: professionally managed apartments, with screened guests, fast responses and a named local person accountable, rarely generate the complaints that turn buildings against short stay. Most body corporate conflict starts with absent, unmanaged listings.

03 · Council Rules

Where Brisbane's council rules stand

Today: no permit, no registration, no annual fee, and no cap on hosting nights. Brisbane City Council's proposed Short Stay Accommodation Local Law, tabled in December 2025, would have introduced a permit system for whole-home short stays. Council paused the proposal on 12 May 2026, so it never came into force.

Two things remain true regardless. First, standard council rates and charges apply as usual. Second, the proposal could return, and our view is that some form of registration is likely before 2032. Owners with professional operations and clean compliance histories will be best placed whatever arrives.

04 · Planning and Building

Planning, building and the practicalities

Most inner-Brisbane apartments can operate as short stay without planning hurdles, but a few checks are worth making:

  • Development approval conditions. Some buildings carry approval conditions about how units may be used. Your body corporate manager or a town planner can confirm.
  • Building and fire safety. Working smoke alarms, safe balconies and clear egress are your responsibility as the owner, guest or tenant regardless.
  • Access logistics. Lifts, fobs, car parks and building entry all need a guest-proof plan. This is an operations question more than a legal one, and it is where professional setup earns its keep.

05 · Insurance

Insurance: the check owners most often skip

Standard landlord and home insurance policies frequently exclude short-term guests. If you list on Airbnb without telling your insurer, you risk discovering the exclusion at claim time, which is the worst possible moment.

You need a policy that explicitly covers short-stay use, including public liability and guest damage. Airbnb's AirCover is a platform protection program with its own terms and limits; it is not a substitute for proper landlord insurance, and it does not cover everything owners assume it does.

Before your first booking: call your insurer, describe exactly how the apartment will be used, and get the answer in writing. If the policy does not cover short stay, switch to one that does.

06 · Being a Good Neighbour

Guests, noise and amenity

Well-run short stays are good neighbours. Proper guest screening, clear house rules, fast responses and a local person the building can actually reach prevent the friction that gives short stay a bad name. We give buildings our direct number; in practice, most concerns die in the first phone call, because there is someone accountable on the other end of it.

Questions to ask before buying an investment apartment

  • Is there an on-site letting pool, and who runs it?
  • How many units in the building already host? A building with an established, well-run short-stay presence is a friendlier starting point.
  • Does the unit have secure parking, fast internet, air conditioning and a workable layout? These move income more than postcode prestige.
  • What are the body corporate fees, and what do they cover? They come straight off your owner income.
  • How does the building handle keys, fobs and guest access?

Every apartment we take on starts with the same honest assessment: location and walkability, building by-laws and access logistics, layout and presentation, parking, and how comparable units are actually performing. Inner-ring apartments are the strongest performers in our market: over the 12 months to August 2026, PriceLabs data shows listings in Brisbane City averaged $4,260 a month in owner revenue and South Brisbane $4,031, against an inner Brisbane average of $4,130.

Apartment questions, answered straight

Can my body corporate stop me?

No. In Queensland, a body corporate cannot lawfully use by-laws to stop you letting your apartment, short stay included. By-laws set the building's house rules, things like guest registration, shared areas and fob access, not whether you can host. We read them as routine for every apartment we take on.

Do I need council approval?

Not today. No permit or registration is currently required in Brisbane. The proposed local law that would have introduced permits was tabled in December 2025 and paused on 12 May 2026. It never came into force, but it may return.

Is Airbnb legal in Brisbane apartments?
